Platform Use

Couloir Trading is a private trading platform providing tools for personal trade execution and portfolio management. By accessing this platform, you agree to use it in accordance with these terms.

Regulatory Status and Important Disclosures

This platform is a software tool, not a regulated financial service:

  • We are NOT a registered broker-dealer with the SEC
  • We are NOT a Futures Commission Merchant (FCM) or Introducing Broker (IB) registered with the CFTC
  • We are NOT a registered investment adviser with the SEC
  • We do NOT provide investment advice, recommendations, or portfolio management services
  • We do NOT provide automated investment advice or algorithmic recommendations
  • We do NOT produce buy or sell signals
  • We do NOT solicit or accept orders for commodity futures or options transactions
  • We do NOT execute trades on your behalf - you maintain full control over all trading decisions
  • We do NOT recommend any particular FCM, broker, or financial intermediary

What This Platform Does: This platform is licensed software that provides technology infrastructure to connect to your own brokerage accounts at the broker or FCM of your choice. The platform allows you to execute trades that you independently decide to make through your existing brokerage relationships. You are responsible for selecting your broker, opening accounts, and making all trading decisions.

Your Responsibility: All trading decisions, strategies, risk management, and outcomes are solely your responsibility. Any market data, analytics, charts, or technical indicators provided are for informational purposes only and do not constitute advice, recommendations, or trading signals.

Account Responsibility

You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Ensuring the accuracy of your account information
  • Notifying us immediately of any unauthorized access

Communications and Notifications

By using the platform, you consent to receive transactional communications via email. If you provide a phone number and explicitly opt in, you consent to receive SMS notifications for the specific message types you select.

Communication Types:

  • Email: Account security alerts, trade notifications, password resets, and system updates
  • SMS/Text Messages (opt-in required): Critical trade alerts, security notifications, and authentication codes

These are transactional messages necessary for platform operation, not marketing. Message frequency varies based on trading activity. Standard message and data rates may apply.

Consent Requirements: For SMS notifications, you must provide explicit consent by opting in through the platform. You will only receive the specific types of SMS messages you consent to receive. Changing to a different type of notification requires new consent.

Opt-Out Rights: You may opt out of optional email notifications through your account settings or by following unsubscribe instructions in any email. For SMS, reply STOP, QUIT, END, CANCEL, UNSUBSCRIBE, or similar words to any message, or opt out through your account settings. We will process opt-out requests within 10 business days. Some critical security communications cannot be disabled while your account is active.

Risk Disclosure - Futures and Options Trading

TRADING FUTURES, OPTIONS, AND DERIVATIVES INVOLVES SUBSTANTIAL RISK OF LOSS AND IS NOT SUITABLE FOR ALL INVESTORS.

You should carefully consider whether trading is appropriate for you in light of your experience, objectives, financial resources, and other relevant circumstances:

  • High Risk of Loss: You may lose all or more than your initial investment. Only risk capital you can afford to lose entirely.
  • Leverage and Margin: Futures and options trading often involves high leverage. Small market movements can result in large gains or losses. Margin calls may require immediate additional capital.
  • Volatility: Markets can be extremely volatile. Prices may gap, slippage may occur, and stop-loss orders may not execute at intended prices.
  • Complexity: Derivatives are complex instruments. You should fully understand the mechanics, risks, and potential outcomes before trading.
  • Past Performance: Past performance is not necessarily indicative of future results. Historical returns do not guarantee future profits.
  • No Guarantees: No trading system, strategy, or algorithm can guarantee profits or eliminate risk.
  • Technology Risk: Platform outages, internet connectivity issues, or system failures may prevent you from executing trades or managing positions.

Platform Data: All market data, analytics, signals, and indicators provided by this platform are for informational purposes only and do not constitute investment advice, recommendations, or solicitations to buy or sell securities or derivatives.

Your Responsibility: You are solely responsible for all trading decisions, risk management, and outcomes. You should consult with qualified financial, legal, and tax advisors before trading.

Service Availability

We strive for 99.9% uptime but cannot guarantee uninterrupted service. The platform may be unavailable due to:

  • Scheduled maintenance
  • System updates
  • Third-party service outages
  • Force majeure events

Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • Trading losses or missed opportunities
  • Data inaccuracies or delays
  • Service interruptions
  • Unauthorized access to your account

Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the platform constitutes acceptance of updated terms.
